These Terms of Use ("Terms") govern your access to and use of the website at dpdpatraining.in ("the Site") operated by Abhisam Software Private Limited ("Abhisam", "we", "us"). By accessing the Site or submitting an enquiry, you agree to these Terms.

Note on scope. These Terms cover use of the marketing website only. Purchase, licensing, and use of the DPDP awareness training course are governed by a separate commercial agreement executed at the time of purchase. Contact for the current course licensing terms.

1. What the Site provides

The Site describes Abhisam's DPDP Act awareness training product, publishes general informational articles about the DPDP Act, 2023 and DPDP Rules, 2025, and provides a contact form for enquiries and quotes.

2. Informational content is not legal advice

The articles, guides, timelines, and course descriptions on the Site are general awareness content prepared to help readers understand the DPDP Act and related regulations at a high level. This content is not legal advice, tax advice, or professional advice of any kind. Use of the Site does not create an attorney-client relationship, a consultant-client relationship, or any similar advisory relationship. For advice specific to your organisation's obligations, engage a qualified legal professional.

3. Acceptable use

You may access the Site for personal review and legitimate business enquiries. You may not:

  • use automated tools (scrapers, bots, crawlers other than compliant search-engine crawlers) to systematically access or copy the Site;
  • reproduce, republish, or resell Site content without our prior written permission;
  • attempt to gain unauthorised access to any part of our infrastructure, or interfere with the operation of the Site;
  • submit false, misleading, or impersonating information through the contact form;
  • use the Site for any unlawful purpose or in violation of applicable Indian law.

All content on the Site — including but not limited to the DPDP awareness course structure, articles, illustrations, brand elements, and design — is owned by Abhisam or its licensors and is protected by Indian copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, adapt, or create derivative works without our prior written consent, except for reasonable personal use such as viewing pages in a browser or printing an article for reference.

5. Course licensing (summary — full terms in commercial agreement)

Where you or your organisation purchases the DPDP awareness training, licensing is generally structured as follows. Precise terms will be in the commercial agreement:

  • licence is per learner, non-transferable between individuals;
  • licence duration and renewal terms are specified in the applicable order;
  • course content may not be recorded, extracted, redistributed, or used to build competing training materials;
  • Abhisam retains all rights not expressly granted.

6. Refunds and cancellation

Refund and cancellation terms for the DPDP training product are specified in the commercial agreement at the time of purchase. General information: because course access is granted immediately on purchase and the course is a digital product, refunds are typically available only in limited circumstances (e.g. duplicate purchase, non-delivery). 7. Third-party links and services

The Site contains links to third-party websites and services (including abhisam.com, rapidcompetency.com, and government resources). We do not control these third parties and are not responsible for their content, availability, or privacy practices. Your interactions with third-party services are governed by their own terms.

8. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content. We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components.

9. Limitation of liability

To the maximum extent permitted by law, Abhisam and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of the Site, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses. Our aggregate liability for any claim arising from or related to the Site shall not exceed the amount you have paid us in the twelve months preceding the claim, or ₹10,000, whichever is higher.

10. Indemnification

You agree to indemnify and hold harmless Abhisam and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of applicable law.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date at the top of this page. Continued use of the Site after changes indicates acceptance of the updated Terms.

12. Governing law and dispute resolution

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts at Thane, Maharashtra, provided that Abhisam Software Private Limited may, at its sole option, initiate proceedings in any other court of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified only to the extent necessary to make it enforceable, and the remaining provisions shall continue in full effect.
